Welcome to Dormity! These Terms of Service (“Terms”) govern your use of the Dormity platform, websites, and mobile applications (collectively, the “Services”). Please read them carefully. By creating an account or using our Services, you agree to these Terms. If you do not agree, do not use Dormity.

1. About Dormity

Dormity is a platform that connects tenants, property managers, and maintenance providers. Through the Services, tenants can pay rent, request maintenance, and purchase add-on services. Property managers can manage leases, payments, and communications.

Important: Dormity does not process or hold funds. All rent and other payments are processed by third-party payment providers integrated into the platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract to use the Services. By using Dormity, you represent and warrant that you meet these requirements.

3. Accounts
  • You are responsible for keeping your account credentials secure.
  • You agree that all information you provide is accurate, complete, and up-to-date.
  • You are responsible for all activity that occurs under your account.
4. Payment Services
  • Payments made through Dormity are facilitated by third-party payment processors (e.g., ACH, debit, or credit card processors).
  • Dormity does not receive, hold, or transmit funds.
  • By using payment features, you also agree to the terms and privacy policies of the payment processor.
  • Fees (such as convenience fees or add-on charges) will be disclosed before checkout.
  • Dormity is not liable for failed transactions, delays, or errors caused by third-party providers.
5. Add-On Services

Tenants may choose optional add-on services (e.g., rent reporting, insurance, maintenance subscriptions).

  • Add-ons are offered either by Dormity or by third-party partners.
  • When provided by third parties, you agree to their terms in addition to ours.
  • Some add-ons may follow your account to new properties if supported by the property manager.
6. User Responsibilities

You agree not to:

  • Use the Services for unlawful purposes.
  • Misrepresent your identity or authority.
  • Attempt to access accounts or data of others without permission.
  • Interfere with or disrupt the Services.
7. Property Manager Responsibilities

If you are a property manager using Dormity, you agree that:

  • You are responsible for your own compliance with housing, rent-collection, and escrow laws.
  • Dormity is not responsible for disputes between you and your tenants.
  • You will not use the Services to collect unlawful fees or charges.
8. Maintenance Requests
  • Dormity provides tools for tenants to submit maintenance requests.
  • Dormity is not responsible for the timeliness or quality of maintenance performed.
  • Property managers and their vendors remain solely responsible.
9. Intellectual Property

Dormity owns all rights, title, and interest in the Services, including software, trademarks, and content. You may not copy, modify, or distribute any part of the Services without permission.

10. Termination

Dormity may suspend or terminate your account if you violate these Terms. You may stop using the Services at any time. Certain obligations (e.g., payment obligations, liability disclaimers) will survive termination.

11. Disclaimers
  • The Services are provided “as is” and “as available.”
  • Dormity does not guarantee uninterrupted or error-free operation.
  • Dormity disclaims all warranties, express or implied, including fitness for a particular purpose.
12. Limitation of Liability
  • Dormity is not liable for indirect, incidental, or consequential damages.
  • Dormity’s total liability for any claim will not exceed the greater of (a) $100 or (b) the amount you paid to Dormity in the past 12 months.
13. Indemnification

You agree to indemnify and hold harmless Dormity, its officers, employees, and partners from any claims, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws principles. Any disputes will be resolved in the courts of Chatham county, Georgia.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide notice (such as by posting in the app or sending an email). Continued use of the Services means you accept the updated Terms.
